Terms of use
These terms govern public use of pdpmauditgroup.com and PowerChart90. Paid enterprise agreements, if executed, control to the extent of conflict.

1. Agreement
By accessing the site or PowerChart90, you agree to these Terms, the Privacy Notice, and (when PHI may be involved) the BAA pathway. If you do not agree, do not use the tools.
2. Who may use the service
You represent that you are authorized by your organization to access the tool, that you will not upload data you lack authority to share, and that you will follow your facility’s privacy and compliance policies.
3. License and ownership
We grant a limited, revocable, non-exclusive license to use PowerChart90 for internal audit-readiness evaluation. We retain all rights in the software, prompts, heuristics, branding, and site content. You retain rights in materials you submit, subject to the license needed for us to process them to provide the service.
4. Acceptable use
- No unlawful use, scraping that degrades service, reverse engineering except where prohibited by law from restriction, or attempts to bypass authentication
- No upload of malware or content intended to disrupt the service
- No representation that automated output is a certified coding determination, survey finding, or legal opinion
5. No professional advice; human review required
Output may be incomplete, incorrect, or non-specific to your source text depending on mode and input quality. You must have qualified clinical, coding, compliance, and/or legal reviewers evaluate every material finding before operational use. Marketing statistics on the homepage are illustrative unless accompanied by a published study design.
6. Data handling
Submitted content is transmitted to our processors as described in the Privacy Notice. Browser-side extraction does not keep analysis solely on-device.
7. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT OUTPUT WILL MATCH CMS, MAC, RAC, or survey outcomes.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PDPM AUDIT OPTIMIZATION GROUP, LLC AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST REVENUE, DENIALS, CIVIL MONEY PENALTIES, OR SURVEY SANCTIONS ARISING FROM USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE PUBLIC TOOLS WILL NOT EXCEED THE GREATER OF FEES PAID TO US FOR THE SERVICE IN THE PRIOR THREE MONTHS OR ONE HUNDRED U.S. DOLLARS (US$100), EXCEPT WHERE A SIGNED ENTERPRISE AGREEMENT SETS A DIFFERENT CAP.
9. Indemnity
You agree to indemnify and hold us harmless from claims arising from your upload of unauthorized data, reliance on output without human review, or violation of these Terms.
10. Termination
We may suspend or terminate access for misuse, security risk, or nonpayment under a paid plan. You may stop using the service at any time. Provisions that by nature should survive (including disclaimers, liability limits, and indemnity) survive termination.
11. Governing law
These Terms are governed by the laws of the State of Utah, excluding conflict-of-law rules, unless a signed customer agreement specifies otherwise. Venue for disputes not subject to a separate agreement lies in state or federal courts located in Utah.
